What values does AI embed in health care? The New England Journal of Medicine AI convened experts on April 22 to debate this critical question. NEJM AI Editor-in-Chief Isaac Kohane, MD, PhD, moderated this webinar on "Value Alignment & Incentive Divergence in Clinical AI." Consortium chair Susan M. Wolf, JD, argued that evaluating AI systems for their legal and ethical alignment with established patients’ rights is crucial. Too often, discussion of law and AI in clinical care ignores the question of what law is “baked into” these tools. She suggested that patients' rights could be violated by healthcare providers using AI tools favoring decisional outcomes that override patient preferences and fail to follow processes required by law and ethics.
